【摘要】:根据法律规定,三维标志与其他要素组合的商标的显著性判断应遵从整体判断的原则。但在判断过程中,这类商标的性质是什么?显著性整体判断尺度究竟如何把握?商标注册后的保护范围应该如何确定?这些都是理论和实务中函待解决的问题。本文认为:此类商标属于组合商标,显著性整体判断原则要考虑四个因素,对此类商标的保护可以区分情况对待。
[Abstract]: According to the law, judgment of distinctiveness of trademarks combining 3D marks and other elements should follow the principle of overall judgment. However, in the course of judgment, what is the nature of such trademarks? How should the yardstick for overall judgment of distinctiveness be understood? How should the scope of protection after trademark registration be determined? These are all questions that need to be solved urgently in theory and practice. This article holds: such trademarks are combined trademarks, the principle of overall judgment of distinctiveness should give consideration to four factors, and protection of such trademarks can be treated in light of different circumstances.

三维标志与其他要素组合的商标,既不同于纯粹的“商品包装物或商品构成的立体外形”的三维标志商标,也不同于文字、图形等普通类型的商标。本文将根据中国法律规定、并参考国外实践,对三维标志与其他要素组合的商标的显著性的三个相关问题进行分析。
